In a victory for Skadden client Matthew Bender & Co., on May 2, the First Department of the New York Appellate Division unanimously affirmed the dismissal of a putative class action that Skadden secured in the Supreme Court for New York County. The plaintiffs alleged that prior editions of Matthew Bender’s annual publication “New York Landlord Tenant Law” — referred to as the “Tanbook” — contained inaccuracies. The plaintiffs asserted that Matthew Bender was liable to all Tanbook purchasers in New York for breach of contract or express warranty, breach of the implied covenant of good faith and fair dealing, consumer deception under General Business Law 349, and fraud. The Appellate Division agreed with the lower court’s dismissal of all claims.
