Matthew Bender Obtains Dismissal of Putative Class Action

On February 20, Skadden secured the dismissal of a putative class action filed in the Supreme Court for the State of New York, New York County on behalf of Matthew Bender & Co. The three named plaintiffs alleged that one section of prior editions of Matthew Bender’s annual publication titled “New York Landlord Tenant Law” — referred to as the “Tanbook” due to the book’s color — contained inaccuracies. The plaintiffs contended that Matthew Bender was liable to a New York class of Tanbook purchasers for breach of contract or warranty, consumer deception under General Business Law 349, fraud, and unjust enrichment. Judge Charles Ramos of the Commercial Division agreed with Matthew Bender that all of the plaintiffs’ claims failed as a matter of law.
