Bio
Judy Flumenbaum’s practice focuses on securities litigation and other complex commercial, corporate, consumer class action and employment disputes in federal and state trial and appellate courts, as well as arbitration proceedings. Ms. Flumenbaum has represented clients in state and federal courts around the country and through all stages of litigation, including dispositive motion practice, fact and expert discovery, and trials and appeals. Some of Ms. Flumenbaum’s recent representations include:
- Betfair Interactive, FanDuel and New Meadowlands Racetrack in securing the settlement of a breach of contract, fraud and civil conspiracy action filed in the Superior Court of New Jersey’s Chancery Division
- a National Football League club in an arbitration brought by its former head coach
- Canopy Growth Corp. in securing the settlement of a securities class action in the U.S. District Court for the District of New Jersey and the dismissal of a securities class action in the U.S. District Court for the Southern District of New York alleging violations of the Securities Exchange Act of 1934 based on allegedly false or misleading statements made in its financial disclosures
- Gaotu Techedu Inc. in several securities class actions in New York and New Jersey federal courts alleging that the company made false and misleading statements regarding its business operations in violation of federal securities laws
- Nio Inc. in several securities class actions in federal and state courts in New York alleging that the company made false and misleading statements regarding its business operation and electric vehicle sales forecast in violation of federal securities laws
- a large financial institution in a three-week bench trial before the Commercial Division of the New York Supreme Court in connection with claims arising out of two structured finance transactions
- Six Flags and its former CEO and CFO in securing the settlement of a putative securities fraud class action originally filed in the U.S. District Court for the Northern District of Texas and in a related derivative action. The securities action was brought by purchasers of Six Flags Entertainment Corporation common stock, alleging that defendants issued false and misleading statements concerning the development of a Six Flags theme park in China
- the underwriting syndicate of various debt and equity offerings by Cobalt International Energy in securing the favorable settlement of a securities action in the U.S. District Court for the Southern District of New York asserting Section 11 claims involving allegations that Cobalt misrepresented and omitted material facts concerning its oil exploration prospects and compliance with the Foreign Corrupt Practices Act
Ms. Flumenbaum maintains an active pro bono practice and has handled a variety of matters, including a recent successful resentencing hearing in New Orleans. She also represented a federal death row prisoner in Roane v. Barr, 05-cv-2337 and won a significant ruling at the district court level regarding the unconstitutionality of execution after a positive COVID diagnosis. Ms. Flumenbaum has also litigated numerous immigration matters and parole determination appeals in New York state courts.
