Anthony J. Balzano
Bio
Anthony Balzano has a wide range of experience in complex civil litigation, with a focus on mass torts and product liability trials. He has represented clients in federal and state courts across the country.
Mr. Balzano has been a core member of nine trial teams, five of which have gone to verdict. Accordingly, he has significant experience working on all aspects of trial preparation and trials, including developing trial strategy for presenting highly complex and technical scientific issues to juries in an easy-to-digest manner, drafting and developing cross-examination outlines for key fact and expert witnesses and preparing key company and expert witnesses for direct trial testimony. He has also worked on coordinating pretrial discovery efforts, coordinating and engaging in meet and confers with opposing counsel on various issues, such as deposition designations, drafting bench briefs and other filings on key evidentiary legal issues and preparing opening and closing statements.
Notably, Mr. Balzano was a member of a trial team that secured a unanimous defense verdict for Ethicon in a civil action in federal court in Florida where the plaintiffs alleged personal injuries from pelvic mesh. He was also a member of a trial team that secured a mistrial for Johnson & Johnson (J&J) in a civil action in Florida state court where the plaintiff alleged his wife’s cancer and death were caused by her alleged use of J&J’s talc-based Baby Powder that was allegedly contaminated with asbestos. He has also argued key pretrial motions, including a Daubert motion to exclude a plaintiff’s key asbestos expert that successfully secured a partial exclusion of that expert’s opinion on the approximate amount of talcum powder the decedent was allegedly exposed to over her lifetime, which the court found to be a speculative expert opinion.
In addition, Mr. Balzano has significant experience preparing for, taking and defending expert depositions in high-stakes product liability cases, including the deposition of the plaintiff’s key specific causation expert in a supplemental deposition in the J&J talcum powder case. Mr. Balzano also defended a key supplemental deposition of a general causation expert in the J&J talcum powder multidistrict litigation.
