Sam Auld litigates antitrust and other complex cases before state and federal courts. He also represents a wide variety of clients in appeals and advises clients on other commercial litigation and regulatory and constitutional issues.

Bio

In recognition of his work, Mr. Auld was named one of Best Lawyers’ 2024 Ones To Watch in America. He also was listed among Lex Machina’s top 10 most active antitrust attorneys in the country from 2021-23.

Among others, Mr. Auld has represented:

  • Caesars Entertainment, Inc. in class actions alleging that casino-hotels engaged in price-fixing through the use of pricing algorithms provided by revenue management software. Mr. Auld helped secure a groundbreaking dismissal of a complaint with prejudice against Caesars and other defendants
  • Greystar in antitrust class actions and actions by state attorneys general alleging that multifamily property managers inflated rents through the use of revenue management software
  • Amadeus Hospitality, Inc. in an antitrust class action concerning hotel room rates
  • Peco Foods in antitrust class actions alleging a conspiracy among broiler chicken producers to reduce output and employee wages
  • Citigroup in an antitrust class action alleging a conspiracy among dealers of U.K. government bonds
  • UniCredit in an antitrust class action alleging a conspiracy among dealers of European government bonds
  • JPMorgan Chase in class actions alleging a conspiracy involving the trading of federal agency bonds and ATM access fees (including successfully seeking certiorari from the U.S. Supreme Court)
  • a former chief executive of a leading telecommunications company in a case alleging defamation
  • Realogy in its successful defense against securities and derivative claims
  • Morgan Stanley & Co LLC in an adversary proceeding in the U.S. District Court for the District of Puerto Rico arising out of the restructuring of the Puerto Rico commonwealth under the Puerto Rico Oversight, Management, and Economic Stability Act. The proceeding involved novel questions of state and constitutional law
  • an indirect auto finance company in challenging a state law as unconstitutional under the First Amendment

Mr. Auld’s appellate representations include:

  • helping secure an en banc victory before the Eleventh Circuit, which ordered the district court to dismiss the plaintiff’s Fair Debt Collection Practices Act claim for lack of Article III standing
  • Equitable Life Insurance in an appeal that presented novel issues under the Federal Rules of Appellate Procedure
  • business organizations and trade associations as amici before appellate courts across the U.S.

Prior to law school, Mr. Auld served as a deputy press secretary to former Ohio Gov. Ted Strickland.
