The U.S. Supreme Court is considering whether Texas death-row inmate Ruben Gutierrez can challenge the constitutionality of the state’s DNA testing statute, which he claims violates due process. Partner Parker Rider-Longmaid, who successfully argued Rodney Reed’s Supreme Court case, explains that Gutierrez’s case mirrors Reed’s and likewise should proceed, because Gutierrez’s merits arguments, if successful, would invalidate all the prosecutor’s reasons for denying DNA testing.
