The Practitioner’s Guide to Global Investigations (Individual Penalties Third-Party Rights: The U.K. Perspective)

European counsel Vanessa McGoldrick and associate Jason Williamson co-authored this chapter, which discusses individual criminal liability for corporate crime in the U.K. The authors highlight the Serious Fraud Office’s mixed success with prosecuting individuals in relation to conduct connected to deferred prosecution agreements, as well as legislative reform that could increase prosecutions against individuals involved in corporate wrongdoing. The chapter also considers the U.K.’s unexplained wealth order and confiscation order regimes, in addition to provisions from the Sentencing Act 2020 that may benefit an offender who assists in the investigation or prosecution of a crime.
