On November 12, Boston litigation partner Eben Colby participated in Investment Company Institute’s annual Closed End Funds conference in New York. During a panel, Mr. Colby and the other session speakers addressed how fund bylaws can be used to defend closed end funds against activist attacks, including recent litigation surrounding the legality of commonly used defensive bylaws. Mr. Colby also addressed how the Firm’s recent trial win on behalf of Eaton Vance funds on claims brought by an activist challenging the legality of a defensive bylaw would broadly benefit the closed end funds industry.
