On August 10, Skadden hosted the webinar “New U.S. Merger Guidelines: Merger Litigation Implications.” Firm speakers included New York antitrust/competition head Karen Lent, Washington, D.C. antitrust/competition head Tara Reinhart, partner Julia York and New York counsel Michael Sheerin. The program reviewed draft merger guidelines released by the FTC and DOJ in July 2023, which include some stark changes from prior guidelines that will impact future merger litigation. The speakers discussed key proposed revisions, compared the new guidelines to current case law and explored potential effects on mergers going forward.
