Palo Alto intellectual property litigation associate Christopher McKinley reviewed Kannuu Pty Ltd. v. Samsung Electronics Co., Ltd, in which the Federal Circuit considers whether a nondisclosure agreement’s forum selection clause extends to Patent Trial and Appeal Board proceedings.
