Norfolk Southern Secures Precedent-Setting Fourth Circuit Victory

Skadden led a team from several firms to secure a precedent-setting victory before the U.S. Court of Appeals for the Fourth Circuit on behalf of Norfolk Southern Railway Co. and Norfolk & Portsmouth Belt Line Railroad Company, defeating an antitrust suit brought by CSX Transportation, Inc. seeking hundreds of millions of dollars in damages. The district court granted summary judgment to Norfolk Southern and Belt Line on statute-of-limitations grounds, and CSX appealed to the Fourth Circuit. The Fourth Circuit affirmed, rejecting all of CSX’s arguments and agreeing with Norfolk Southern and Belt Line across the board.
