Skadden secured a ruling from the U.S. Court of Appeals for the Ninth Circuit affirming dismissal of claims alleging that client Anheuser-Busch InBev's $20.1 billion acquisition of Grupo Modelo violated federal antitrust laws. On April 4, the Ninth Circuit held that the plaintiffs failed to establish a prima facie case that the transaction was anticompetitive and that, contrary to their assertions, the lower court did not err by considering the transaction agreements in dismissing the plaintiffs' claims.
