Court Decides California Underpaid Judges and Judicial Pensioners

On December 16, 2015, Skadden secured a complete victory in California State Court for Retired Justice Robert M. Mallano — individually and on behalf of a class of more than 3,000 California judges, justices and judicial pensioners — in a declaratory judgment action brought against the controller of the state of California and the board of administration of the Public Employees Retirement System of the State of California. The court ruled that the controller failed to implement mandated salary increases for sitting California judges and justices from 2008-15 and that the defendants underpaid judicial salaries and pension benefits during that time.
