Appellate Court Orders Confirmation of Arbitration Award to Port Arthur Steam Energy

On behalf of Port Arthur Steam Energy LP, Skadden obtained an appellate victory that reversed a trial court’s decision to vacate an arbitration award for our client because of an alleged conflict with the arbitrator. On October 22, a First Court of Appeals of Texas panel unanimously ruled that the trial court erred in vacating the award, noting the absence of any evidence of the arbitrator's knowledge of the alleged conflict.
