Skadden secured the dismissal of an ERISA benefits class action filed against Anheuser-Busch Companies, Inc. by employees of its former subsidiary Metal Container Corporation, alleging that Anheuser-Busch was required to pay them enhanced pension benefits following its merger with InBev. On January 9, Judge James L. Graham of the U.S. District Court for the Southern District of Ohio rejected the plaintiffs' claim that Anheuser-Busch's interpretation of the relevant pension plan provisions was arbitrary and capricious.
