On behalf of client Norfolk Southern Railway Company, Skadden secured an affirmance of dismissal of a putative class action seeking damages for individuals who voluntarily evacuated their homes following a Jan. 6, 2005, train collision and derailment in Graniteville, S.C. On November 5, the U.S. Court of Appeals for the Fourth Circuit issued a unanimous opinion affirming the lower court's decision, which Skadden also handled.
